Eire
If your contract with the debtor provides for the English courts to have jurisdiction, then you can start proceedings here. If your contract was for the supply of goods and services and this was to take place in Eire, then proceedings can only be taken in Eire. If it was for anything else, then it may be possible to sue in England and Wales.
Where appropriate, we will issue proceedings in England at no extra cost to you. If Judgment and Enforcement are required, the case will be transferred to local agents.
Other European Countries
For most debts, it is usually advisable to take proceedings in the debtor's country. Although this means that the substance of the dispute is dealt with abroad, the advantage is that the enforcement fee - which can be significant, and may be unrecoverable - is avoided. Taking proceedings in the UK would generally be recommended only for large debts.
In both types of case, foreign lawyers will often be required and we will instruct and manage the process on your behalf.
Non-European Countries
Considerations here are the same as for European countries, although we will need to check with lawyers in the foreign country whether their jurisdiction will recognise an English judgment. We would obviously investigate the costs of taking proceedings here or overseas before recommending a course of action.
