Our Direct to Claim service

Where you already send a Final Demand on your own company headed paper to a UK debtor threatening legal action and want to avoid any further delay of Lovetts sending an LBA or LPD we can issue a Claim straight away for you. However, to safeguard you, we do strongly recommend that you have complied with the Civil Procedure Rules.

To do this the courts require that before issuing a claim certain procedures have been met. These procedures are set out in the Civil Procedure Rules and associated Pre-Action Protocols.

We want to make you aware of the requirements placed upon you by the Court under these rules.

You should send a letter to each debtor setting out clearly any sums owed, and how they have been calculated.

Where a query has been raised you should give the debtor at least 14 days to substantiate any query

You must provide any copy documents or information requested by the other party as soon as possible. If you are unable to do so then an explanation must be given as to why the documentation and/or information is not available.

Where the debtor is an individual you should comply with the Pre-Action Protocol by including information on sources of debt advice in the demand letter sent to each debtor

If the protocol is not followed the court can:

  • Stay proceedings to allow steps which should have been taken to be taken and
  • Penalise the party at fault by the amount of the costs and/or interest they have to pay/can recover
  • If you are unsure on any of these points we will be happy to discuss them with you.

Most of our actions are issued electronically through the Claim Production Centre (CPC) or the County Court Bulk Centre (CCBC).

The CPC handles the automated issue of Claims. The CCBC handles both the automated issue of Claims (via the CPC) and the automated entry of judgments. Instead of preparing Claims, Judgment and Warrants on paper, we send the CPC/CCBC instructions electronically. Our instructions are then processed automatically.

The CCBC is more efficient than a local county court when it comes to issuing proceedings, entering judgment and issuing enforcement. However, it can only be used where there are 1 or 2 defendants.
